Terms & Conditions

Making a booking with MK Shortstay you are deemed to have read and accepted the following Terms and Conditions:-

ID must be given at time of check-in in the form of a valid passport or Driving Licence.

The Guest should use the Booking Confirmation email or telephone call as a receipt to confirm the booking made with MK Shortstay.

1. Booking & Payment Procedure
All payments are due in advance of occupation. Credit card details will need to be held on file to cover any damages or other costs. Bookings will be confirmed on receipt of payment. Upon receipt of the appropriate payment we will send you written confirmation of your booking by email or telephone. You may extend your stay at any time, subject to availability. No extra fees are Charged for late bookings, but payment must be made in full and should be paid by bank Transfer or credit card (add 3% for credit card payment) and debit cards (0% charge). Internationally issued credit cards have an extra charge of 1.20% on top of the payment fee.    
If you intend to pay by bank transfer this should reach our account net of all bank charges. Please ask your bank to show your name and booking reference on the transfer. A transfer should also be sent/e-mailed to us. All prices quoted are in UK Pounds Sterling and are correct at the time of Publication. Payment must be made to us in UK Sterling in the Following forms: Sterling, Direct Bank Transfer, credit and debit cards. On line Bookings must be made by, or with the consent of, the cardholder. Guests must be at least 18 years old to make a booking with MK Shortstay.

2. Cancellation Policy
For all bookings 3 nights or more, cancellations must be confirmed in writing by emailing info@mkshortstay.co.uk, before 10.00AM and at least 7 days prior to arrival. Guests making cancellations outside this period will be charged for the total stay. Guests making cancellations within the above period will be eligible for a full refund. Bookings for our apartments / houses are almost always made in advance and for relatively lengthy stays. It is very difficult, therefore, to re-let a poperty after a booking has been cancelled at short notice.
* 1 and 2 night rentals stays are non-refundable or transferable.
* No refunds will be made for non-arrivals.
* The booking will be cancelled on the day that the written notice of cancellation is received by us.
Depending on the reasons for your cancellation, you may be able to reclaim cancellation charges from your insurance company if you have taken out travel insurance. We strongly recommend that clients purchase adequate travel insurance. Regrettably, for the reasons given above, we have to treat any curtailment of your stay as a cancellation.

3. Amendments to bookings
If you wish to amend your booking (e.g. change the dates of your stay or the accommodation requested), we will use all our reasonable efforts to comply with your request, however you will be obliged to pay for any additional expenses that are incurred as a result. In addition, we may charge, at our discretion. If you decide to change your stay in any way once it has commenced (e.g. change accommodation or the duration of your stay), we accept no liability for any loss, damage or additional expense and we cannot guarantee a refund of any costs already paid by you.

4. If we cancel your booking
In exceptional circumstances we may find it necessary to cancel your booking and if so, we shall make all reasonable efforts to offer a suitable alternative, if we cannot offer you alternative accommodation we will give a full refund for the dates we cannot accommodate.

5. If we alter your booking
If it is necessary to alter the confirmed itinerary before departure, we will use all reasonable efforts to notify you as soon as possible. If these alterations are unacceptable you may cancel that part of your booking that relates to the alteration and receives a full refund for that part of the booking, which shall constitute a full settlement.

6. Facilities & Services
Please note: No items Must be removed from the apartment or dismantled in any way or moved within the apartment during your stay, We cannot guarantee, or be held responsible for any failure or interruption of, services to the apartment or the building, including electricity, air conditioning, water or any damage, telephone, television, broadband, internet and other communications, disruption or noise caused as a result of repair works being carried out in another part of the property. However, upon notification by you, we will use our reasonable endeavours to maintain and rectify (within a reasonable period of time) all services to our properties. The weekly rental includes a weekly maid service that cleans the apartment and refreshes the bed linen and towels. Extra linen provided will be at a rate of £30.00 per set.

7. Number of Occupants
The maximum number of people as agreed on your booking confirmation can stay at any one time. Only those persons listed on the Booking Form may occupy the property. Babies up to two years of age sharing a bed with parents stay free. The property cannot be re-let/sublet to any other group/party without the written approval of MK Shortstay. The number of persons permitted to occupy the property is limited to the number of beds available. Under no circumstances may more than the maximum number of persons specified in the property description occupy the apartment / house. MK Shortstay reserves the right to refuse admittance to the apartment / house to the hirer and their party if they are in breach of this condition.

8. Check-in and Check-out
Check-in is from 3.00pm. Check-out is by 10.00am. On departing, keys are to be returned on day of departure by 10am. If there is a delay in departing then Mk Shortstay reserve the right to charge for one extra night’s stay.

9. Damage to Apartment / House: Payment of Additional Charges
Valid credit/debit card details must be supplied at the time of booking to cover additional charges incurred during your stay with us, including breakages, damages and missing items. We reserve the right to deduct from the relevant credit/debit card, without further notice, all amounts chargeable under these conditions, including, but not limited to: Further Accommodation charges, Telephone Calls: Telephone calls are not permitted and therefore charged separately together with an excess fee of £50.00 due to breach / misuse of property. Broadband: Broadband is available in all property locations. Where Broadband is offered, we will make every effort to ensure that the service is available at all times, but we cannot guarantee any Internet or broadband connection availability. If there is a fault which is deemed by us to be associated with the user’s hardware or software, no support will be available. Standard broadband is Complimentary; however, upgraded bandwidth is chargeable. Other Chargeable Services: Details of other additional services are available on request. Cleaning: We expect the apartments / houses to be left in a reasonable state on departure. If, at our absolute discretion we consider additional cleaning is required on departure, the cost of this cleaning will be charged as an additional charge. When the duration of the reservation Is in excess of 28 days, a final cleaning charge of £50 will be added and charged for the stay, and up to £150 may be charged If an apartment / house is deemed unfit for occupation, you will be obliged to pay compensation to us for loss of revenues in addition to the costs of cleaning and repair. We reserve the right to Charge £150 (in addition to the general cleaning charges) for specialist cleaning to an apartment / house and/or its contents where we believe smoking has taken place in the property, or for stale / pungent cooking odour, or any unpleasant odour, in order to restore the property to a pleasant condition. Damages: Damages to the apartment or contents must be paid in full by you. In the event of any breakages or damage or missing items discovered during your stay or after you vacate, we will notify you by e-mail or telephone immediately or within 10 days of your departure, providing a detailed breakdown of the damage and where is possible a cost of rectification. Where possible, photographic evidence will also be supplied. It is your responsibility to check all items & that there is no damage to these items. Condition reports can also be provided at the beginning and at the end of the accommodation period if requested. Nothing in these terms and conditions limits or excludes our liability for death or personal injury resulting from our negligence or for any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation by us or any liability that cannot by law be excluded.
Subject to the above, we shall not be liable for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of use, loss of Corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses. If you are booking for, as or on behalf of a business or business employee, that business shall indemnify us against all liabilities, costs, expenses, damages and losses (including any direct or indirect consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other reasonable Professional costs and expenses) suffered or incurred by us arising out of or in connection with your, or your businesses, breach or negligent performance or non-performance of these terms and conditions. If you are booking for, as or on behalf of a business or business employee, our total liability in contract, tort
(Including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of your booking shall be limited to the fees paid to us under your booking. We shall not be liable for any failure or delay in performance of our obligations which results directly or Indirectly from any cause or circumstance which is beyond our reasonable control, including (but not Exclusively) act of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of Any government or authority (including but not limited to refusal or revocation of any licence or consent),
Fire, flood, lightning, explosion, fog or bad weather, interruption or failure of a utility service (including but Not limited to electricity, gas, water or telecommunications), renovations undertaken at the property, strikes, lockouts or boycotts, embargo, blockade.
Other than in relation to death or personal injury caused by our negligence, or any other liability that by law Cannot be excluded or restricted, our liability to you in relation to these conditions is limited to the higher of (i) GBP £1,000; and (ii) the value of the booking made with us.
Car Parking: If a car parking space is reserved, the space will be available from 2pm on the day of arrival and must be vacated by 10.00am on the day of departure unless otherwise agreed in writing at the time of the booking. If vehicles have not been removed by 10.15am on the day of departure then an additional day’s car parking charge will be payable of £55.00.
If vehicles have not been removed by 2pm on the day of departure then we reserve the right to clamp vehicles and a charge of [£200 ] will be payable to release the clamp If a clamp is forcibly removed then a charge of [£200] will be payable plus the cost of repairing or replacing, the damaged clamp all vehicles and their contents are left entirely at their owner’s risk We will not be liable for the theft of or damage to your vehicle or its contents.
Lost Keys: If between the hours of 9pm and 9am you lock yourself out of the property and/or the apartment and require assistance to re-enter the property and/or the apartment, we reserve the right to charge £150.00 call out charge in addition to the charge for the lost keys. If keys are lost or not returned on the day of departure by 10am, then we reserve the right to charge you £85.00 per lock, for locks to be changed and £30.00 per new keys to be cut.
Call Outs: If the emergency call out number is used to call out the property manager between the Hours of 6pm and 9am for any purpose other than an emergency relating to the building facilities or services, we reserve the right to charge you a call out fee of £150.00. Within 14 days of any deduction of any additional charges from a debit / credit card, we will provide you by e-mail or otherwise with a breakdown of the additional charges. In relation to any additional charges. The hirer is responsible for taking all reasonable care of the property and its contents. The property and all equipment, utensils, furniture etc. must be left clean and tidy at the end of the hire period. Except in the case of normal wear and tear the hirer will be responsible for making good any damage to the apartment / house or its contents which has occurred due to negligence, wilful damage or irresponsible behaviour on the part of those occupying the apartment / house or their guests. Such damage must be reported, without delay, to our office. The cost of the repair or replacement must be agreed with and paid to MK Shortstay. Should an apartment / house require a deep clean due to misuse or smoking then an additional charge of up to £150.00 will be incurred by the guest. The hirer is responsible for booking undertakes that no person will suffer anything to be done which would endanger the policy of our insurers in respect of the property and its contents which might make the same Void or avoidable.

10. Liability
We are not responsible for the theft and/or damage of your personal belongings during your stay in any property booked. Therefore you are advised to ensure you have appropriate insurances in place. All warranties, conditions and other terms implied by statute or common Law or otherwise are, to the fullest extent permitted by law, excluded from any contract with
Us and these conditions shall apply in their place. We regret that we cannot accept liability for any loss, damage or additional expense where the booking needs to be altered or cancelled or we are unable to perform our contractual obligations As a result of events of ‘force majeure’. In these Booking Conditions ‘force majeure’ means any Event which could not have been reasonably foreseen, or the consequences could not have been Reasonably avoided, by us or the suppliers of the relevant services in question, even with the Exercise of all due care. Such events may include war or threat of war, civil strife, terrorist activity, Industrial dispute, natural or man-made disaster, fire, adverse weather conditions and all similar Events outside our or the relevant suppliers’ control.
Nothing in these terms and conditions shall affect your statutory rights if you are a consumer.

11. Law & Jurisdiction
These conditions and terms of contract and all matters arising there from are subject to the Law of England and Wales and in the event of dispute; the client will be subject to the Exclusive jurisdiction of the courts of England and Wales.

12. Termination by MK Shortstay
MK Shortstay has the right to terminate a booking at any time on the grounds of abuse to staff or other guests, mistreatment of the apartment or criminal activity on the part of those occupying the apartment / house or their guests. Hen and Stag parties are not permitted and guests will be vacated if reported by neighbours in such circumstances, MK Shortstay is not obliged to provide or locate alternative accommodation. The period of notice and the proportion of refund are at the discretion of MK Shortstay.

13. Injury or Loss
MK Shortstay cannot be held responsible for any personal injury, loss or damage to personal effects howsoever arising at the accommodation. Neither we, nor our representatives, can be held responsible for any circumstances beyond our control including, but not limited to, mechanical breakdown, illness or failure of any Public service supply.

14. Rights of Access
Representatives of MK Shortstay or their subcontractors have the right of access to the property at any time, with due regard to the convenience of the hirer, for the purpose of Inspection of the property and to carry out any essential repair or maintenance work.

15. Pets
Regrettably no pets of any kind are permitted under any circumstances. The client is liable for any infringement of this rule by the client’s occupiers.

16. Smoking
Smoking is not permitted in the apartments / houses or in the internal communal areas of an apartment block. Smoking is permitted on external balconies / areas where present in an apartment only. A surcharge of £150.00 will be made if evidence of smoking is discovered in the property.

17. Complaints
We do not expect and certainly do not want dissatisfied customers, but in the event that you are not entirely satisfied with the service offered, you should notify any complaint to our office as soon as possible to MK Shortstay by email to info@mkshortstay.co.uk we will take all reasonable steps to settle the problem. MK Shortstay shall not have any Liability for any complaint submitted after the completion of the rental period.

18. Information
All information supplied by MK Shortstay, is given in good faith and is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of any statement made either in writing or otherwise, but MK Shortstay is not liable for any variation however caused.

19. Interest
Interest on overdue invoices shall accrue from the date when payment becomes due, From day to day, until the date of payment, at a rate of 4% above NatWest Bank base rate In force at the time and shall accrue at such a rate after, as well as before any judgement.

20. Security of Tenure
As the apartments / houses are used as serviced holiday accommodation they are exempt from security of tenure under the Rent Act. MK Shortstay reserves the right to access the apartment / house at any time without prior notice if it deems necessary.

21. Usage & Nuisance Behaviour
The properties cannot under any circumstances be used for partying, playing loud music or general nuisance behaviour. Guests must have regard for other occupants in the building, and for neighbouring properties. Loud music cannot be played after 10pm and before 11am. MK Shortstay Management Reserve the right to terminate your stay and contract if they deem such behaviour has occurred. In the event of such a breach the FULL security deposit will be retained by MK Shortstay. No refund will be made if such behaviour is deemed to have occurred.

22. Apartment Specification
Reasonable care has been taken that the content of our website (and/or other means of promotion or advertising) is correct but it is subject to amendment at any time without notice. All content on our website (and/or other means of promotion or advertising) is published in good faith. We do not warrant that the content of our website (and/or other means of promotion or advertising) accurately or completely describe any of the apartments / houses. Our web site may link to other web sites and we are not responsible for the data policies, content or security of these web sites. You should note the following points about apartments / houses:
* Apartments / houses are individual and vary in style, size and layouts so furnishing details are not uniformly standard. Although accommodation and location are confirmed in advance, the exact apartment / house cannot be guaranteed prior to arrival;
* Our website (and/or other means of promotion or advertising) may contain a plan of the layout of the property. The plan will only be a general representation of the accommodation. Actual unit size, design, fixtures, furnishings and facilities may vary from those shown on the plan;
* The number of people permitted to occupy each property is limited to the number of beds. In some properties extra beds can be provided and this will be at a charge to be agreed at the time of booking. If the number of people permitted to occupy an apartment / house is exceeded, we may refuse access to the accommodation and reserve the right to charge for additional apartments;
* You and your party must comply with any rules and regulations set by us. We recommend that you take time to familiarise yourself with the safety procedures in the apartments/houses, the building and local area, paying particular attention to fire evacuation details and security;
* You and the other members of your party are responsible for payment of any charges made for use of facilities, such as but not limited to broadband, additional laundry services, and for any other fees levied by us for the use of amenities;
* Accommodation may not be able to operate heating and air-conditioning at any one time.
* Where internet or broadband connectivity is available, you agree to use such services in a responsible manner and not for any illegal purpose.
* We shall use reasonable endeavours to retain any items left in apartments for up to 3 month after the guest’s departure date. Please email info@mkshortstay.co.uk enquiries relating to any lost items.

23. Acceptance of Terms and Conditions / Contract of Hire
All bookings are subject to these terms and conditions that are deemed to have been accepted in full by the hirer and all persons in the party. Payment of deposit and/or apartment / house fee also indicates acceptance of these Terms and Conditions.
